jane, clock is ticking. >> reporter: we are a month away from the start of the school year here in philadelphia and we still don't know if schools will indeed open up on time and we don't know what classrooms will look like if they do opened but that is all about to change. src was supposed to hold a special meeting tomorrow to discuss just this, that has been scrapped, instead, as team members and superintendent william hite will make a big announcement about the future of the school district. it is hundreds of philadelphia schoolteachers, including nefertiti white continue to experience year after a year. >> 2011 i was the receiving even of the layoff notice. i was fortunate enough to get called back in august but you sees where you don't know whether you will come back to your job. >> reporter: now again with the 81 million-dollar deficit the school district of philadelphia is facing another round of tough cuts. possible layoffs, class sizes, up to 40 kids and cuts to programs, even security. >> this is basically a

national embarrassment. >> reporter: as decision looms at headquarters whether schools even have the funds to open safely on september 8th, state senator vincent hughes called on his colleagues in harrisburg to get back to work. >> we need to take care of the cigarette tax and take that done but we need a fair funding formula. >> it is a formula that ties needs of different school district the funding. >> reporter: together he and gubernatorial candidate tom wolf faulted a lack of leadership but spokesperson for governor tom corbett says basic education funning commission was just create todd explore what would constitute the a fair formula. in the meantime parents feel caught in the middle. >> this whole school open on time. >> reporter: just last week governor corbett did advance millions in state fund as schools could open but jill yam hite says that shifts new money feign new money isn't found wow have to layoff 1300 employees. now that proposed and now stalled $2 per pack cigarette tax was supposed to plug this

"eyewitness news" reporter diana rocco is live at love park with more on what will happen here tonight, diana? >> reporter: chris, as you mentioned this event is scheduled to get underway just about an hour from now. we have already seen a number of people showing up, organizers stress this is not a rally or a protest but a moment of cile tones remember 18 year-old mike brown and, of course, he is teenager who was killed in ferguson on saturday, shot by police, the suburbs of st. louis. there have been days of unrest there, community members are demanding answers, and today state's governor is announcing a highway patrol will be taking over and replacing the town's police force and police chief. national moment of silence is also on to honor other who tied at the hand of police and stand with those in ferguson who have been seeing four days of rallies, riots and protest. tonight president obama asked for peace. >> when something like this

second court appearance today. >> mr. fattah you have been on talk shows, you have spoken extensively to us why aren't you able to talk to us today? >> reporter: chaka fattah had much less to say at his second appearance in federal court where he pleaded not guilty to charges he defrauded the philadelphia school district, banks and irs out of hundreds of thousands of dollars. >> in the past you have spoken to us at length and spoken on the radio and print you are not talking to day. >> i stand by what i said. >> reporter: following his indictment nine days ago fattah junior had spoken at length with reporters claiming his prosecution was part of the vendetta aimed at his father congressman chaka fattah a claim he reiterated as he left court. >> you really feel like this prosecution is driven by some kind of vengeance in your father. >> no doubt bit. >> reporter: since his first court appearance here august 5th when he was indicted, fattah junior's legal situation has become much more complicated. specifically his former

roommate has now pleaded guilty on federal fraud charges, agreeing to cooperate with the government and even testify against him. are you concerned at all with the decision by your roommate to plead guilty to charges at all. despite his quiet key meaner fattah junior did make a very clear prediction about the outcome of his upcoming trial. >> i will be completely vindicated. >> reporter: he remains free, on bail, at the u.s. courthouse, walt hunter, cbs-3 "eyewitness news". search is on tonight the for person who killed a man at a concert, that was ironically, promoting peace. it happened outside dell music center in fairmount park, a man in his 20's was rush to the hospital where he was pronounced dead. now to a wild police chase through philadelphia's manayunk neighborhood that ended with a crash. chopper three over the scene near flat rock road this morning. that driver ran away after the crash and police aren't sure if the driver ran deeper in to

the brush or just into the schuylkill river. there is in word on what prompt that had chase. new information now on that big casino heist at caesars atlantic city. today we have over first look at five of the eight suspects in this case. investigators believe it was an inside job. state police tell us they believe that isaiah plumber and aaron evans entered the casino through a side door and then robbed it of $180,000. caesars had fired plumber just a few weeks earlier from his job as a security guard. >> during the robbery they pointed a gun at one of the employees as money exchange was taking place and they left with proceeds of approximately $180,000 through that side door. >> investigators say they have recovered about $150,000 worth of cash property and drugs. the also of note the a delaware state trooper was shot during manhunt for two of these suspects that he was not seriously injured. democratic national convention site committee is
